Messaging Privacy Policy

The Profit Brokers LLC collects your mobile number and consent only when you submit them at theprofitbrokers.com/optin. We use them only to send the messages you asked for. We never sell or share mobile information with third parties for their own marketing.
No mobile information will be sold, rented, or shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent are not shared with any third parties, except with the service providers described in this policy who help us deliver messages on our behalf.
1. Scope
This Messaging Privacy Policy explains how The Profit Brokers LLC ("we," "us," or "our"), a Colorado limited liability company, handles information collected through our SMS text message program. It applies to our opt-in page and to the text messages we send. Read it alongside our Messaging Terms & Conditions.
2. What we collect
When you submit our opt-in form we collect:
- Your mobile phone number.
- Which consents you selected — informational, marketing, or both.
- The exact consent language shown to you at the time you agreed.
- The date and time of your submission and the page address where you submitted it.
We also retain the content of messages exchanged with you, and delivery status information such as whether a message was delivered or you replied STOP.
We do not knowingly collect information from anyone under 18.
3. Why we collect it
- To send the messages you asked for. Appointment confirmations, reminders, replies to your questions, follow-ups, account updates, and — only if you gave the separate marketing consent — occasional offers and business updates.
- To honor your choices. Processing STOP and HELP requests, and keeping a record of who has opted out.
- To prove consent. We keep the consent record as evidence that you agreed, which is required by wireless carriers and applicable law.
- To operate and secure the program. Troubleshooting delivery problems and preventing abuse.
4. Who we share it with
We share your information only with service providers who process it on our behalf, under contract, for the purposes described above. They may not use it for their own marketing:
- Lexi AI, a product of Peako Enterprises, LLC — our messaging software provider, which stores consent records and sends messages on our behalf.
- Twilio Inc. — the communications platform that transmits messages to wireless carriers.
- Wireless carriers — which deliver messages to your device.
We may also disclose information where required by law, subpoena, or valid legal process, or to protect our rights, safety, or property. If our business is ever sold or merged, information may transfer as part of that transaction, subject to this policy.
Outside of these cases, we do not sell, rent, trade, or otherwise disclose your mobile number or your consent to anyone.
5. How long we keep it
We keep your mobile number and message history for as long as you remain opted in, and for a reasonable period afterward to comply with recordkeeping obligations. Consent and opt-out records are retained for at least four years, which is the period wireless carriers and applicable regulations expect. You can ask us to delete your information; we will honor the request except where we must keep a record that you opted out, so we do not accidentally message you again.
6. Your choices
- Stop messages. Reply STOP to any message. This is immediate.
- Get help. Reply HELP to any message.
- Access, correct, or delete. Email [email protected] or call 303-775-7113 and tell us what you would like us to do.
Colorado residents have rights under the Colorado Privacy Act, including the right to access, correct, delete, and obtain a copy of personal data, and the right to opt out of targeted advertising and the sale of personal data. We do not sell personal data. Residents of other states may have similar rights. Use the contact details above to exercise them; we will verify your identity before acting on a request.
7. Security
We use reasonable administrative and technical safeguards to protect the information we hold, including encrypted transmission and access controls at our service providers. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
8. Changes to this policy
We may update this policy from time to time. The effective date at the top of this page reflects the most recent version. Material changes affecting how we use mobile information will be communicated to active subscribers.
